NOTICE OF SALE OF REAL ESTATE

WHEREAS, by Deed of Trust dated October 6, 2023, recorded in the Register's Office of Carroll County, Tennessee, in Trust Deed Book 735, Page 643 ("Trust Deed"), Misty Dawn White conveyed to Investors Title Company, Trustee, the real estate therein described, to secure the payment of certain indebtedness therein described; and

WHEREAS, default has been made in the payment of the indebtedness secured by the Trust Deed, and FirstBank, the lawful holder of the indebtedness, has declared the entire balance due and payable; and

WHEREAS, Adam C. Crider was appointed Successor Trustee by instrument appearing of record in Trust Deed Book 744, Page 223 in the Register's Office of Carroll County, Tennessee.

NOW, THEREFORE, notice is hereby given that on Wednesday, October 30, 2024 at 10:00 a.m., at the main door of the Courthouse in Huntingdon, Carroll County, Tennessee, I will sell to the last, highest and best bidder for cash and in bar of all appraisement, homestead exemption, and curtesy and dower rights and equitable and statutory rights of redemption, all of which were expressly waived in the Trust Deed, the following real estate, lying and being in the 16th Civil District of Carroll County, Tennessee, and more particularly described as follows:

The property described on Deed of Trust of record in Trust Deed Book 735, Page 643, in the Register's Office of Carroll County, Tennessee.

No opinion is rendered by the Successor Trustee as to the accuracy of the legal description.

The street address of the property is 30 Park Lane, Hollow Rock, Tennessee and the property is shown as Map 066H Group C Parcel 008.03 in the Carroll County Tax Assessor's Office.

Said property will be sold by me as Successor Trustee only and subject to any unpaid taxes and assessments and all valid restrictions, covenants or easements, if any, of record on said property, and subject to any and all other liens having priority over the Trust Deed. The Successor Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale. The Successor Trustee may postpone any sale hereunder to another time or place by so announcing to all present at the time and place of the sale scheduled herein, without the necessity of any further notice whatsoever. The Successor Trustee reserves the right to sell the tracts together or in separate parcels and in such manner or order deemed appropriate by the Successor Trustee.

This cause came to be heard upon Petitioner’s Motion for Service by Publication brought pursuant to Tennessee Code Sections 21-1-203 and 21-1-204. The Court finds:

The last known specific address for Respondent Brittany Hayes was 163 Browning, Huntingdon, Carroll County, Tennessee.

The Petitioner has made reasonable, good faith efforts to locate and serve the Respondent with process. These efforts have been unsuccessful.

The Respondent’s current residence is unknown, and cannot be ascertained upon diligent inquiry.

IT IS THEREFORE ORDERED that Respondent Brittany Hayes enter her appearance herein by the 4th day of December, 2024 at 9:00 a.m., a rule day of said Court, and that a copy of this Order be published for four consecutive weeks in the Carroll County News Leader, 84 Elks Lodge Rd., Huntingdon, Tennessee 38344, a newspaper distributed in Carroll County, Tennessee. Further, a final hearing on the Petitioner’s Petition to Modify the Parenting Plan Order is scheduled for the 4th day of December, 2024 at 9:00 a.m. Failure of the Respondent to appear at the final hearing could result in judgment against them.

It appearing to the Court from the allegations of the Petition to Adjudicate Dependency and Neglect, to Transfer Temporary Legal Custody, and For Ex Parte Order, the Motion for Service by Publication and the Affidavit of Diligent Search that the whereabouts of Lathan Gilbreath are unknown and cannot be ascertained by diligent search; therefore, the ordinary process of law cannot be served upon Lathan Gilbreath.

It appears that ordinary process of law cannot be served upon Lathan Gilbreath because his whereabouts are unknown. Lathan Gilbreath is hereby ORDERED TO APPEAR IN THE GIBSON COUNTY JUVENILE COURT IN TRENTON, TENNESSEE ON NOVEMBER 13, 2024, AT 9:00 A.M., to defend the allegations or a default judgement shall be taken against you. You may view and obtain a copy of the Petition and any other subsequently filed legal documents at the Gibson County Juvenile Court Clerk’s Office in Trenton, Tennessee.
