WHEREAS, on the 26th day of January, 2015, by Deed of Trust recorded in the Register's Office of Carroll County, Tennessee, at Huntingdon, in Trust Deed Book 639, Page 1064, CHARLES WASHINGTON, conveyed the following described property in trust to DWAYNE D. MADDOX, III, Trustee, to secure the payment of a Promissory Note in the original principal sum of Fifty-Five Thousand and No/100 ($55,000.00) Dollars in favor of HABITAT FOR HUMANITY OF CARROLL COUNTY, INC.; and
WHEREAS, on the 26th day of January, 2015, by Deed of Trust recorded in the Register's Office of Carroll County, Tennessee, at Huntingdon, in Trust Deed Book 639, Page 1067, CHARLES WASHINGTON, conveyed the following described property in trust to DWAYNE D. MADDOX, III, Trustee, to secure the payment of a Promissory Note in the original principal sum of Twenty-Five Thousand and No/100 ($25,000.00) Dollars in favor of HABITAT FOR HUMANITY OF CARROLL COUNTY, INC.; and
WHEREAS, said Deeds of Trust provide that in the event of default of any of the conditions and/or covenants of said Deeds of Trust, the entire indebtedness shall at the option of the holder and owner thereof become due and payable; and
WHEREAS, default has been made in the payment of the said indebtedness, and HABITAT FOR HUMANITY OF CARROLL COUNTY, INC. has declared the entire unpaid balance due and payable, and the undersigned Trustee has been directed to foreclose the Deeds of Trust in accordance with the terms thereof. The public is hereby notified that the undersigned will sell the hereinafter described real property at public auction to the highest and best bidder for cash at the East Court House door of the Carroll County Courthouse at Huntingdon, Tennessee, at 10:01 a.m., Central Standard Time, on Monday, April 21, 2025, said property to be sold in bar of the equity of redemption, homestead, dower and curtsey and the statutory right of redemption and subject to the lien of property taxes and all special assessments against it.
The real estate to be sold is located in the 22nd Civil District of Carroll County, Tennessee, and is more particularly described as follows:

In the Town of McKenzie, Tennessee, and BOUNDED on the North by what was W. B. McDonald; on the East by street; on the South by Lee Oglesby; and on the West what was W. B. McDonald and forms a lot fronting to the East 120 by 200 feet.
The Grantee hereby grants a first right of refusal to Habitat for Humanity of Carroll County, Inc. at a price equal to the purchase price herein plus any improvements that the Grantee may have made to said real estate less any depreciation.
Grantee further agrees that as long as there is a balance due and owing under a Promissory Note and Deed of Trust in favor of Habitat for Humanity of Carroll County, Inc., that this property shall not be leased or rented and must be occupied by the Grantee as his primary residence.
The Grantee, his heirs and assigns, for and in consideration of receiving direct subsidy funds from the Federal Home Loan Bank of Cincinnati’s Affordable Housing Program, must maintain ownership and reside in and upon this property as their primary residence for a period of five (5) years (Retention Period) from the date of the recording of this deed.
(I) The Federal Home Loan Bank of Cincinnati, whose mailing address is P.O. Box 598, Cincinnati, OH 45201-0598, is to be given notice of any sale or refinancing of the unit occurring prior to the end of the Retention Period.
(II) In the case of a sale prior to the end of the Retention Period, an amount equal to a pro rata share of the direct Subsidy that financed the purchase, construction, or rehabilitation of the unit, reduced for every year the seller owned the unit, shall be repaid to The Federal Home Loan Bank of Cincinnati from any net gain realized upon the sale of the unit after deduction for sales expenses, unless the purchaser is a low- or moderate-income household as defined in the applicable Federal Housing Finance Board regulations for the AHP; and
(III) In the case of a refinancing prior to the end of the Retention Period, an amount equal to a pro rata share of the direct Subsidy that financed the purchase, construction, or rehabilitation of the unit, reduced for every year the occupying household has owned the unit, shall be repaid to The Federal Home Loan Bank of Cincinnati from any net gain realized upon the refinancing, unless the unit continues to be subject to a deed restriction or other legally enforceable retention agreement or mechanism, incorporating the requirements of clauses (I), (II), (III), and (IV) contained herein.
(IV) The obligation to repay Subsidy to the Bank shall terminate after any foreclosure.
During such time as the property described herein is used for a purpose for which assistance under the Housing Opportunity Program Extension Act of 1996, P.L. 104-120, was provided or for another purpose involving the provision of similar services or benefits, then no person having an interest in this property shall refuse service for or accommodation or other benefits to any person with respect to the property on account of the person’s race, color or national origin or otherwise engage in discrimination conduct of any kind on account of a person’s race, color or national origin with respect to the property. This covenant shall run with the land.
This being the same property conveyed to Charles Washington by deed from Habitat for Humanity of Carroll County, Inc. dated January 26, 2015 and recorded in Deed Book 368, Page 841 in the Register’s Office of Carroll County, Tennessee.
Charles Washington, one and the same as Charles Edward Washington, departed this life on September 7, 2024.
The street address of the property is believed to be 100 Park Lane, McKenzie, Tennessee 38201, but such address is not a part of the legal description and in the event of any discrepancy, said legal description herein shall control.
This is an attempt to collect a debt, and any information obtained will be used for that purpose.
