It is, therefore, ORDERED that Fadia Chamoun be served by publication of the following notice for four consecutive weeks in the Carroll County News Leader, a newspaper published in Carroll County, Tennessee. 

It is further ORDERED that if Fadia Chamoun does not enter an appearance or otherwise Answer the Petition, further personal service or service by further publication shall be dispensed with and service of any future notices, motions, orders or other legal documents in this matter may be made upon Fadia Chamoun by filing same with the Juvenile Court Clerk of Benton County, Tennessee.

The State of Tennessee, Department of Children’s Services, has filed a petition against Fadia Chamoun seeking to adjudicate dependency and neglect.  It appears that ordinary process of law cannot be served upon Fadia Chamoun because her whereabouts are unknown.  Fadia Chamoun is hereby ORDERED TO APPEAR IN THE BENTON COUNTY JUVENILE COURT IN CAMDEN, TENNESSEE ON NOVEMBER 14, 2024, AT 9:00 A.M., to defend the allegations or a default judgement shall be taken against you.  You may view and obtain a copy of the Petition and any other subsequently filed legal documents at the Benton County Juvenile Court Clerk’s Office in Camden, Tennessee.

ELIMINATION OF DANGEROUS STRUCTURES

COMPLAINT

To: GLENDA D. TUCKER OR THE INDIVIDUALS OWNING OR CONTROLLING THE PREMISES KNOWN AS 4080 HIGHWAY 22, HUNTINGDON, CARROLL COUNTY, TENNESSEE

Take notice that the Town Recorder of Clarksburg, Tennessee, acting as the designated public officer of said municipality asserts and complains that: 

Real property with improvements located at 4080 Highway 22, Huntingdon, Carroll County, Tennessee, and further identified as Tax Map 142, Parcel 11.00 of the records of the Property Assessor of Carroll County, Tennessee, owned and/or controlled by Glenda D. Tucker, is a public nuisance, and dangerous and unfit for use.  For further title reference, see Warranty Deed Book 385, at Page 524, in the Register’s Office of Carroll County, Tennessee.

NOTICE

A public hearing will be conducted before the governing body, the Mayor and Board of Aldermen, of the City on September 23, 2024 at 5:30 p.m. in the board room of the City Hall of the City of Clarksburg located at 65 Clarksburg Road.  All parties in interest may appear in person or by counsel at said hearing and may answer the Complaint there or earlier in writing.  Testimony may be taken at the time and place of the hearing.  Specifically, it is alleged that the dwelling is a public nuisance and that the property is consumed with junk, debris and an accumulation of weeds and other overgrown vegetation constituting a safety hazard which is in violation of C.M.C. §13-202.

The governing body shall, at the said hearing, determine whether the structure under consideration is dangerous or unfit for human occupation or use, pursuant to C.M.C. §13-205.  Additionally, the governing body will determine whether the property is a public nuisance pursuant to C.M.C. §13-203.  If said structure is determined to be a nuisance and dangerous or unfit, then an Order will issue relative to the described structure ordering its demolition or rehabilitation.

Comes now Leigh Grice after being duly sworn and saith as follows:

  1. I am the City Recorder for Clarksburg, Tennessee.
  2. In compliance with Clarksburg Municipal Code §13-204, I have attempted, through reasonable diligence and effort, and with the assistance of counsel, to locate and serve notice upon all the owners of the real property located at 4080 Highway 22, within the corporate limits of the City, and shown on the Tax Assessor’s Map of Carroll County, Tennessee, as Tax Map 142, Parcel 11.00, which deed appears of record in Warranty Deed Book 385, at Page 524, in the Register’s Office of Carroll County, Tennessee.  Such attempted notice is relative to a certain Complaint, pursuant to Clarksburg Municipal Code §13-203 and §13-205 relative to public nuisance and dangerous structures.  Those owners whose whereabouts are known will attempt to be or have been notified by certified mail.  However, I am unable to ascertain the whereabouts of all the owners or those in control of said premises.  Notice to such persons is therefore proper through official publication.
