Lake BZA allows compromise

A compromise was allowed by the Carroll County Lake Zoning Board of Appeals on Dec 5 concerning  the allowance of two principal structures to be allowed on a piece of property temporarily.

According to Community Planner Donny Bunton, Wayne Chris Trevathan of 15005 Highway 70 had requested for two principal buildings to be allowed on property located at that address.

“The property has an existing dwelling located on it, which is proposed to be replaced by a manufactured home,” said Bunton. “The request states that the existing home will be removed after installation of the manufactured home is complete.”

The property is split by M-RC and L-3 zoning districts, but the area where the proposed manufactured home would be located is zoned M-RC. According to M-RC provisions, only one principal structure per property is allowed.

Bunton said by following the regulations to the letter it would require the existing house to be demolished prior to the manufactured home being placed on the lot, or that the property would be subdivided so that each principal structure would have its own lot.

He mentioned a potential and previously utilized compromise had been used and could be used in this case. It would allow for a zoning compliance permit to be issued for the placement of the manufactured home, so long as a copy of the demolition contract to remove the existing dwelling is provided prior to its issuance.

Board member Brad Hurley made the motion that the allowance be passed with all board members present voting yes that included John Austin, Cayce Maddox and Rita Jones. Board member Tony Tucker was absent.
